These Terms and Conditions ("Terms") govern the relationship between Pure Vitality Coaching FZCO ("Company", "we", "us") and the client ("Client", "you"). By booking a coaching session or purchasing a package or program, you agree to these Terms.

1. Scope of Services

Pure Vitality Coaching FZCO provides life coaching (mind and emotions), personal training and lifestyle coaching (body, fitness, movement and healthy habits), coaching programs and the Pure Vitality Mentorship. Sessions take place online via video call or in person in Dubai. Personal training takes place at the Client's home, in the Client's residential building gym or online. Coaching is a collaborative process and the results depend on the Client's commitment and actions. We do not guarantee any specific results.
These Terms apply to every session, package and program the Client books or purchases with Pure Vitality Coaching FZCO, including sessions the Company schedules on the Client’s behalf at the Client’s request (for example outside regular availability). Acceptance given at the Client’s first booking remains valid for all subsequent sessions.

2. Professional & Health Disclaimer

Pure Vitality Coaching FZCO provides coaching and educational services only. Our services, programs and materials are not intended as, and shall not be understood or construed as, medical or professional health advice.

No Doctor-Patient Relationship: Use of our services does not create a doctor-patient or therapist-client relationship. Our services do not include the diagnosis, therapy or treatment of any physical or mental health condition.

Not a Substitute: Coaching is not a substitute for advice from a qualified medical professional. Always consult your physician before starting any new diet, exercise or lifestyle program. Persons with diagnosed mental health conditions (depression, PTSD, anxiety disorders, schizophrenia, etc.) must consult a doctor before starting with coaching services and are strongly advised to obtain medical clearance before doing so. By enrolling in coaching, clients confirm that they have either fulfilled this requirement or that no such condition applies to them.

Health Questionnaire for Personal Training: Before the first personal training session, the Client completes a written health questionnaire truthfully and completely. The Client informs the trainer without delay about any change in their health, including new injuries, pain, pregnancy, medication or symptoms. If the answers indicate a risk, the trainer may adapt or postpone the training or ask for medical clearance first.

Training Environment: For sessions at the Client's home or in the Client's building gym, the Client is responsible for providing a safe and suitable space. The Client's own equipment and the equipment of the building are not maintained by the Company. For online sessions, the Client is responsible for a safe training space and suitable equipment. The Client stops the exercise immediately and informs the trainer if they feel pain, dizziness, chest discomfort or shortness of breath.

Nutrition Guidance: General nutrition guidance is provided for healthy adults as part of lifestyle coaching. It is not medical nutrition therapy and does not replace advice from a doctor or a registered dietitian.

Emergencies: Our services are not an emergency service. In an emergency, please contact your local emergency services immediately.

Personal Responsibility: The Client takes full responsibility for their health and well-being and for any decisions made based on the coaching process. Subject to Section 9, Pure Vitality Coaching FZCO is not liable for any physical or mental health issues arising from the Client's implementation of the information provided.

3. Disclaimer for Financial Decisions

The services provided by Pure Vitality Coaching FZCO are intended solely for personal development, particularly in the areas of mental, emotional and body coaching. They do not constitute financial, investment, tax or legal advice.

All content, guidance and recommendations offered by Pure Vitality Coaching FZCO are intended to support individual decision-making. The Client retains full responsibility for any decisions made, especially those with financial implications.

Pure Vitality Coaching FZCO shall not be held liable for any financial losses or other damages incurred as a result of decisions or actions taken by the Client based on the coaching services.

4. Booking and Payment

All sessions must be paid for in advance unless otherwise agreed in writing.

Payments are processed in USD (United States Dollar) as specified on the invoice.

The Company reserves the right to suspend services if payments are overdue.

5. Cancellation and Rescheduling Policy

To ensure a professional workflow, we apply the following policy:

Rescheduling: You may reschedule a session up to 24 hours before the scheduled time at no extra cost.

Late Cancellation: Cancellations made less than 24 hours before the session will be charged at 100% of the session fee.

No-Show: If the Client does not show up for a scheduled session, the session will be forfeited and not refunded.

6. Coaching Packages: Validity, Expiry and Refunds

Validity Period: The coaching programs Blueprint, Signature and Hybrid are valid for 100 calendar days from the date of purchase. The 5-session and 10-session packages are valid for 365 calendar days from the date of purchase. All sessions and services included in a package must be used within its validity period. The validity period of each package is stated on our website at the time of purchase.

Expiry: Sessions or services not used by the Client within the validity period expire automatically and will not be refunded, credited or transferred, except as set out under "Sessions Not Delivered by the Company" below.

Extensions: Upon the Client's written request, the Company may extend the validity period in exceptional cases. Any extension must be confirmed by the Company in writing.

Refunds: Coaching packages are non-refundable once the first session has commenced, except as set out under "Sessions Not Delivered by the Company" below.

Sessions Not Delivered by the Company: If a session cannot take place for reasons attributable to the Company (e.g. cancellation or unavailability of the coach), the Client will be offered a replacement session. If no replacement session can be provided within the validity period, the Client may choose between an extension of the validity period by the corresponding time or a pro-rata refund for the affected sessions. The Client's statutory rights under UAE law remain unaffected.

7. Confidentiality

The Company keeps all information shared by the Client confidential. Information is only disclosed where disclosure is required by UAE law, where there is a serious risk of harm to the Client or others, or with the Client's explicit consent.

8. Intellectual Property

All materials provided (worksheets, guides, videos) are the intellectual property of Pure Vitality Coaching FZCO and are for the Client's personal use only. Distribution or commercial use is strictly prohibited.

9. Limitation of Liability

To the maximum extent permitted by UAE law, Pure Vitality Coaching FZCO shall not be liable for any indirect, incidental or consequential damages resulting from the use of our services. Total liability is limited to the amount paid by the Client for the specific service in question. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under UAE law, in particular liability for death or personal injury caused by negligence, for gross negligence, wilful misconduct or fraud.

10. Age Requirement

Our services are available only to individuals aged 18 years or older. By booking, the Client confirms that they are at least 18 years old.

11. Changes to these Terms

We may update these Terms from time to time. The current version is published on our website with the date of the last update. Material changes apply to existing clients only after we have notified them by email and they have accepted the updated version, for example by ticking the consent box at their next booking or by confirming in writing.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.
